InJAMES Subscription Agreement

1. Parties to the Agreement

This Subscription Agreement (“Agreement”) is entered into between Pink Unicorn LLC (“Provider”, “we”, “our”) and the subscriber (“Customer”, “you”) who registers for and uses the InJAMES service.

2. Description of Services

InJAMES provides AI-powered call monitoring and scam detection services, including features such as real-time call analysis, call interruption on suspected scams, encrypted transcriptions, and the ability to share scam data with third parties.

3. Subscription Plans and Fees

We offer the following subscription options:
– **Monthly Plan**: $14.95 per month, billed monthly, auto-renews unless canceled.
– **Annual Plan**: $150.00 per year, billed annually, auto-renews unless canceled.
– **Ad-hoc Plan**: Requires an active account and valid payment method. Billed per usage at $6.95 per call plus $1.00 per minute.

Customers may upgrade from the Monthly Plan to the Annual Plan at any time. The Annual Plan will begin at the end of the current monthly billing cycle and extend for one full year.

4. Term and Renewal

Your subscription begins on the date you activate the plan and will continue until canceled. Monthly and Annual subscriptions automatically renew unless you cancel prior to the renewal date.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings:
– **Monthly Subscribers**: Will continue to have access until the end of the current billing month. No refunds are issued for partial months.
– **Annual Subscribers**: Will have access until the end of the current billing month. A pro-rata refund will be issued, calculated as the annual fee minus $14.95 for each month the service was used.

Ad-hoc usage is non-refundable once the call has started.

6. Payment and Billing

By subscribing, you authorize us to charge your provided payment method for the applicable fees. All fees are in U.S. dollars and are exclusive of any applicable taxes. You are responsible for keeping your payment method current.

7. Account Use and Restrictions

Each account is for a single user. Sharing account credentials or using the service for unauthorized commercial purposes is prohibited.

8. Data Retention and Access

Call transcripts are stored encrypted and accessible only by you. Transcripts are deleted after 30 days unless marked to keep. Data is permanently deleted upon account cancellation in accordance with the Wisconsin Data Privacy Act.

9. Changes to the Agreement

We may update this Agreement at our discretion. You will be notified of any material changes. Continued use of the service constitutes your acceptance of the new terms.

10. Limitation of Liability

To the maximum extent permitted by law, our liability under this Agreement shall be limited to the amount paid by you in the 12 months preceding the claim. The service is provided “as is” without warranties of any kind.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.
